These Terms and Conditions form an integral part of the Registration and Service Consent agreement and govern the Services provided under the agreement entered between Krishhari Healthcare PVT LTD (“Aroha Cares”) and the Customer.
DEFINITIONS
Under these Terms and Conditions, unless the context otherwise requires, the following expressions shall have the meanings assigned below:
a. Customer: The individual purchasing the Service(s) identified under the Service Consent Form, and is either the Patient himself/herself or the family/relative purchasing the Service(s) for the Patient.
b. Caregiver: The person assigned by Aroha Cares to provide the requisite Service(s) to the Patient as requested in the Service Consent Form.
• For Nursing Caregiver Service – Nurse
• For Patient Caregiver Service – General Duty Assistant
• For Critical Care at Home – Nurse or Nurse and GDA
1. SERVICES PROVIDED
Aroha Cares agrees to assign a Caregiver to the Patient for the requested Service(s) at the requested Location as per agreed requirements. Services shall be provided only during the agreed shift hours and duration. Any change in service location or duration must be informed in advance and is subject to approval and availability.
2. CHANGES TO SCHEDULE
All requests for changes in service schedule (timings, shift hours, days, or duration) must be communicated through official Aroha Cares communication channels and not directly to the Caregiver. A minimum 24-hour prior notice is required, except in genuine emergencies. Schedule changes are subject to availability and operational feasibility.
3. CANCELLATION OF SHIFT
If the Customer cancels a scheduled shift, Aroha Cares must be notified in writing at least 24 hours in advance except in emergencies. Failure to provide such notice will make the Customer liable for the full shift payment.
4. TERMINATION OF SERVICES
The Customer may terminate the Service(s) or Contract in writing to the Supervisor/Manager at least 24 hours prior to the scheduled shift. Termination of the Contract will automatically terminate all ongoing Service(s).
5. TERMINATION BY AROHA CARES
Aroha Cares may terminate the Contract immediately if:
a. The Customer poses a threat to themselves or the Caregiver.
b. Care requirements exceed the scope of assigned services.
c. Payment obligations are not fulfilled.
d. The work environment is unsafe for the Caregiver.
6. RESPONSIBILITY & LIABILITY
A. The Customer must safeguard personal belongings and mandatorily check the Caregiver’s belongings at the end of each shift. Aroha Cares is not liable for any pilferage, theft, damage, or loss.
B. Aroha Cares acts solely for the benefit of the Patient and shall not be liable for third-party claims. The Customer agrees to indemnify Aroha Cares and its staff against all claims, losses, or legal expenses.
C. Customer Responsibilities:
a. Ensure a safe and secure working environment for the Caregiver.
b. Be responsible for the safety of Aroha Cares property and equipment.
c. If services are obstructed by the Customer or household members, Aroha Cares may withdraw services without liability.
d. For 24-hour services, Customer must provide:
• Food
• Clean and hygienic washroom
• Space and consumables for cleaning clothes
• Adequate rest time and space
D. Customer shall not hand over house keys or access codes to the Caregiver without written approval from Aroha Cares.
7. EMPLOYMENT OF CAREGIVER
The Customer shall not solicit or privately employ any Caregiver assigned by Aroha Cares. Any such breach will result in immediate termination and a claim for damages.
8. PAYMENT TERMS
Payments must be made in advance with a minimum 10-day lock-in period and payable only to Krishhari Healthcare Pvt Ltd. Any discontinuation during this period requires payment for the entire lock-in duration.
9. PAYMENTS TO CAREGIVERS
Customers should not make direct payments to Caregivers. Aroha Cares is not responsible for any direct payments made to staff.
10. CAREGIVER RECOGNITION
Customers may recognize Caregivers through written appreciation sent to the Manager/Supervisor. Any gifts require prior approval.
11. FORCE MAJEURE
Aroha Cares shall not be liable for delays or non-performance due to events beyond reasonable control including acts of God, pandemics, strikes, or government actions. Outstanding payment obligations remain unaffected.
12. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India. Courts in Gurgaon shall have exclusive jurisdiction.
13. ACKNOWLEDGEMENT & ACCEPTANCE
The Customer acknowledges understanding and acceptance of these Terms and authorizes Aroha Cares to provide the requested Service(s), including medical and care-related services as required, in accordance with applicable laws.
